1. Agreement to Terms

By accessing or using the ToGrad mobile application ("App") and website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all visitors, users, and others who access the Service. By using the Service, you represent that you are at least 13 years old, or that you have obtained parental or guardian consent to use the Service.

2. Description of Service

ToGrad is an academic progress tracking application designed for South African learners and students. The Service includes:

APS (Admission Point Score) calculation and tracking for Grade 12 learners
GPA calculation and module tracking for university students
Study session timing and streak tracking
Bursary and scholarship opportunity discovery
Social features including posts, connections, and study groups
Push notifications for reminders and updates

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

To use certain features of the Service, you must create an account. When you create an account, you agree to:

Provide accurate, current, and complete information
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Post content that is offensive, harmful, threatening, abusive, or harassing
Impersonate any person or entity
Share misleading or false academic information
Upload malicious code or attempt to compromise the Service
Collect or harvest user information without consent
Spam or send unsolicited messages to other users
Interfere with or disrupt the Service or its servers

5. User Content

You retain ownership of content you create and post on the Service ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content in connection with the Service.

We may remove User Content that violates these Terms or that we deem inappropriate at our sole discretion.

6. Academic Information Disclaimer

Important: ToGrad provides tools for tracking and calculating academic metrics (APS, GPA, module marks). These calculations are for informational purposes only and should not be considered official academic records.

Always verify your official marks and APS scores with your school, university, or the relevant examining body.

7. Opportunities and Third-Party Services

The Service may display bursary, scholarship, and other opportunities from third-party organizations. We:

Do not guarantee the accuracy or availability of opportunities
Are not responsible for the actions of third-party organizations
Do not endorse or vouch for any particular opportunity
Encourage you to independently verify all opportunity information

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by ToGrad and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Advertising

The App does not currently display third-party advertisements. If we introduce advertising in the future, you will be notified and may opt out of personalized advertising through your device settings.

10. Limitation of Liability

To the fullest extent permitted by law, ToGrad shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

Loss of profits, data, or use
Academic decisions made based on information from the Service
Missed deadlines or application opportunities
Any damages arising from your use of the Service

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason. You may delete your account at any time through the App settings.
